These Terms of Service ("Terms") govern your use of websites operated by Bosque Works LLC ("Bosque Works," "we," "us," or "our"), including bosqueworks.com and any lead-generation landing pages we operate on behalf of contractor partners. By using our websites or services, you agree to these Terms.

1. Services We Provide

Bosque Works LLC provides:

• Web design and development services for local trades and service businesses, including custom site design, hosting, maintenance, and ongoing support.
• Lead-generation services for licensed local contractors, including operating landing pages, capturing service inquiries from consumers, and delivering qualified inquiries to contractor partners.

Specific terms for web design engagements (scope, payment, intellectual property, revisions) are established in individual service agreements signed at project start. Specific terms for lead-generation subscriptions (price, exclusivity, delivery, refund and cancellation) are established in individual subscription agreements signed by contractor partners. These Terms apply in addition to any such agreement and govern your general use of our websites.

2. Eligibility

You must be at least 18 years old to use our services or submit a service inquiry. By using our websites, you represent that you meet this age requirement and that the information you provide is accurate and complete.

3. SMS Terms

By providing your mobile phone number on a Bosque Works form, replying to a message, or verbally opting in during a call, you consent to receive SMS text messages from Bosque Works LLC or from a contractor partner on our behalf, as described below.

• Program description: SMS communications from Bosque Works include service-related messages such as inquiry confirmations, appointment reminders, follow-ups from a contractor partner you have requested service from, and account or subscription notifications for our contractor partners.
• Message frequency: Message frequency varies based on your interaction with us and the service you have requested. You may receive transactional messages as needed and, where you have opted in, occasional service updates.
• Message and data rates: Message and data rates may apply, depending on your mobile carrier and plan. Bosque Works LLC is not responsible for charges from your mobile carrier.
• HELP: Reply HELP to any SMS for assistance, or contact us at cody@bosqueworks.com or (254) 277-2131.
• STOP: Reply STOP to any SMS at any time to opt out. You will receive a single confirmation message and will not receive further SMS from that program. You may receive SMS again only by re-opting in.
• Supported carriers: AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, and other major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
• Privacy: See our Privacy Policy for information about how we collect, use, and protect SMS-related data. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

4. Acceptable Use

When using our websites or services, you agree not to:

• Submit false, misleading, or fraudulent information on any form.
• Submit inquiries on behalf of someone else without their permission.
• Attempt to interfere with, disrupt, or gain unauthorized access to our systems.
• Use our services for any unlawful purpose or in violation of applicable laws.
• Use automated tools, bots, or scripts to interact with our forms or services.

We reserve the right to refuse service, decline to deliver an inquiry to a contractor partner, or terminate access for users who violate these Terms.

5. Lead-Generation Service Disclaimer

When you submit an inquiry through one of our lead-generation pages, Bosque Works connects you with a licensed local contractor in your service area. The contractor is an independent business; the work performed, pricing offered, and any contractual relationship resulting from the inquiry is between you and the contractor. Bosque Works does not perform the underlying trade work, does not guarantee any specific outcome, and is not responsible for the contractor's conduct, workmanship, pricing, or compliance with applicable laws. We recommend you verify any contractor's licensing, insurance, and references before engaging them.

6. Intellectual Property

Our websites and their content (including text, design, code, logos, and graphics, except for content provided by users or contractor partners) are owned by Bosque Works LLC and are protected by copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission, except as expressly permitted by law.

7. Third-Party Services

Our websites and services rely on third-party providers (including Cloudflare, Twilio, Resend, and Stripe). Your interactions with these providers are governed by their respective terms and privacy policies in addition to ours. We are not responsible for the conduct, content, or practices of third-party services.

8. Disclaimers

Our websites and services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Bosque Works LLC, its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our websites or services. Our total aggregate liability for any claim arising out of or related to these Terms or your use of our websites or services is limited to the greater of (a) the amount you paid us in the 30 days preceding the claim, or (b) one hundred U.S. dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Bosque Works LLC and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms or your misuse of our services.

11. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of our services will be resolved exclusively in the state or federal courts located in Erath County, Texas, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of our websites or services after a change indicates your acceptance of the updated Terms. Material changes will be communicated through a notice on our website or by direct contact.
